By accessing or using redwaterrev.com (the "Site") or engaging Redwater Revenue's services, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site or our services. These are general Site and service terms. They are not a substitute for the individual signed services agreement (proposal or statement of work) you enter with us. Where the two conflict, the signed client agreement controls for that engagement.
Redwater Revenue is an AI automation and software studio based in Louisiana. We design, build, and host custom software, CRMs, dashboards, and AI enabled automations for businesses.
You agree to use the Site lawfully and not to misuse, disrupt, or attempt to gain unauthorized access to the Site or its systems; submit false information, or another person's information without permission; scrape, copy, or exploit Site content except as permitted; or use the Site to transmit malware or unlawful, infringing, or harmful content. We may suspend or restrict access to the Site at any time for any reason.
The Site's descriptions of services are for general information and are not an offer or guarantee. Specific scope, deliverables, timelines, fees, and payment terms are defined in a separate written proposal or statement of work ("Client Agreement") signed by you and Redwater. Deposits and fees are handled through third party payment processors (such as Stripe and Square). By paying, you also agree to those processors' terms. Payments are due as stated in your Client Agreement. Custom software work is iterative. We aim to deliver the outcomes described in your Client Agreement and will work in good faith to adjust scope as needs are clarified. Specific deliverables and any guarantees are defined in that Agreement.
Site content (text, graphics, logos, and design) is owned by Redwater or its licensors and is protected by law. You may not reproduce it without permission. Ownership of deliverables we build for you (code, configurations, designs) is governed by your Client Agreement. Absent other terms, Redwater retains ownership of its pre existing tools, templates, and know how, and grants you a license to use the delivered work.
Our deliverables and the Site rely on third party platforms (for example, hosting, database, email, payment, telephony, calendar, and AI providers). We are not responsible for the acts, omissions, availability, or terms of those third parties. Where our software uses AI providers to process data, that processing is governed by our Data Processing Addendum and the applicable Client Agreement. AI generated output can contain errors and should be reviewed by a human before it is relied upon.
The Site and any general information we provide are offered "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the Site will be uninterrupted, error free, or secure. Nothing on the Site is legal, financial, or professional advice. Warranties specific to paid engagements, if any, are stated in your Client Agreement.
To the maximum extent permitted by law, Redwater and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits or data, arising from your use of the Site. For any liability arising from your use of the Site, our total liability will not exceed $100. Liability for paid engagements is limited as set out in your Client Agreement.
You agree to indemnify and hold harmless Redwater and its owners from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.
These Terms are governed by the laws of the State of Louisiana, without regard to its conflict of laws rules. Any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in St. Landry Parish, Louisiana, and you consent to that jurisdiction.
We may update these Terms at any time by posting the revised version here with a new "Last updated" date. Continued use of the Site after changes means you accept the revised Terms.
